What is a 'no win no fee' agreement?
A "no win no fee" agreement means you can make a personal injury claim without any financial risk to you. EV Law Scotland operates on a "no win-no fee" basis. We offer a risk free, personal injury package at no cost to you.
If, following your initial meeting with one of our legal team whether by phone, email exchange or in person, a decision is made to take your case on, then we will provide you with access to justice at no cost. If you lose the case, you simply “walk away”, with NO legal fees to pay and NO liability for the other side’s legal costs.
If you’ve been involved in a road traffic accident, the process of preparing your claim will involve expense. However, right from the start, you can rest assured we will not ask you to pay any expenses.
We take the view that if you have at least a 50% prospect of success, we will fund your case for you. We will pay for medical reports, Police reports and even road traffic accident reconstruction costs.
If we cannot get agreement from the Insurer to settle your case, it may be necessary to raise proceedings in Court. So long as you have at least a 50% prospect of success, we will continue to fund your case.
On successful conclusion of a case, we will charge a success fee capped at 15% of the damages awarded. The success fee reduces down depending on the settlement figure. Our track record in winning cases is strong and experience counts.
Even if we lose the Court action, you will not have to pay a penny as long as you have been honest with us from the start. The only time you would have to pay any Court costs would be if it was decided the claim was fraudulent.
What will I have to pay for?
If you are eligible to make a personal injury claim because you have been involved in a road traffic accident, you won't have to pay for any expenses such as Police reports, specialist services or medical reports. There will be no cost to you for making a claim.
What percentage do 'no win no fee' solicitors take?
It very much depends on the solicitor, but at EV Law Scotland we guarantee that if your claim is successful you will receive at least 85% of your damages.
